In January this year, during a concentrated inspection operation, police officers from Chuantou Police Station in Yunnan Province discovered a foreign woman working illegally in a foot massage parlor. After investigation, it was found that the owner of the foot massage parlor had hired the foreign woman to engage in business activities despite knowing that she did not have a work permit, which constituted the illegal employment in China of foreigners.
Act of Illegal Employment in China
(1) Working in China without obtaining the work permit and work-related residence permit as required;
(2) Working in China beyond the scope specified in the work permit;
(3) Foreign students working in China in violation of the regulations on part-time jobs for students, beyond the prescribed job scope or time limit.

Consequences of Illegal Employment in China
For foreigners who engage in illegal employment in China, a fine of between 5,000 yuan and 20,000 yuan shall be imposed; if the circumstances are serious, they shall be detained for five days to fifteen days, and a fine of between 5,000 yuan and 20,000 yuan shall also be imposed.
For cases assisting illegal employment of foreigners, individuals will be fined 5,000 yuan for each illegal introduction, with the total fine not exceeding 50,000 yuan; for units, the fine will be 5,000 yuan for each illegal introduction, with the total fine not exceeding 100,000 yuan. If there are any illegal gains, the illegal gains will be confiscated.
Those who illegally employ foreigners shall be fined 10,000 yuan for each person employed illegally, with the total fine not exceeding 100,000 yuan. If there are any illegal gains, the illegal gains shall be confiscated.

How to Avoid Illegal Employment in China
Obtaining relevant documents:
When applying for a work permit, certain conditions must be met, such as being over 18 years old, being in good health, and having no criminal record, etc. When applying for a work-related residence permit, one needs to apply to the exit-entry administration agency of the local people's government at or above the county level in the place of residence within 30 days after entering the country.
Choose a regular company:
Ensure that the employer has no serious violations or bad credit records, and that this job has specific requirements, as there are no suitable candidates available in China.
Pay attention to the scope of work and time limit:
Do not exceed the restricted area, job position scope and time limit as stipulated in the work permit. Before applying for a residence permit, foreign students must obtain the consent of their schools and go to the relevant management departments to add information to their residence documents, indicating the location and duration of part-time jobs or internships, etc.
Choose formal recruitment channels:
Seek job opportunities through formal human resource service agencies, government employment service platforms, the official websites of well-known enterprises, etc., and avoid applying through "illegal agencies" or recruitment websites of unknown origin.
